can a Muslim father force his NON Muslim ex-wife to hand over their daughter to him claiming that since he is a Muslim and she is a NON Muslim - she cant raise his child the way he wants.

Does he have any legal claim??

ah good.. my sis and i were so gleeful when we saw the news footage where she said she herself wanted to live in pak & as a muslim.. we thought this was a blow for all the western anti muslim propagandists who keep stressing how harmful islam is / how chauvinistic and dictatorial muslim dads are..

i guess her mum realised what her daughter wants and that leaving her be will be in her best interests

you need to check the facts.. i thought it was more like.. the prescribed upbringing according to sharia was < 7 - with mother .. 7 - 14 - with father .. 14 - 21 - with relative with the next claim usually the mothers mother or father mother etc...

Riya is going to be 7 this year - according to muslim/shuria a daughter over the age of 7 can not be in custody to the father after a divorce..

does this apply to a non-muslim mother too!!!!!!!!!!

if he goes to pak thats bad news - shariah or kangaroo courts can sometimes decide a nonmuslim environment is no place for a kid who should be in a muslim environment.. the only reason i think the latest uk case didnt reach this conclusion and the girl (molly) was sent back to her mum in the uk was possibly the risk of pressure from the uk government/ uk-pak relations being strained.. i would ask your friend to consult a us lawyer and us state dept/ pak embassy for advice

they are at the moment in USA but the chances of Junaid (the father) taking the child to Pak is HIGH and thats why the mother is concerend

i think men have been allowed to do this in the past - in arab countries/ pakistan at least.. depends largely on which country they're living in
