Awareness Could Keep Women In Safe Zone


?There are so many laws in Islam that would turn off any educated person completely. One such law is the Shia custom of Sigeh, or temporary marriage?In a temporary marriage, the man specifies the term of the contract. He asks a woman or her guardian if she would marry him for any amount of time from ten minutes to an hour, a week, or some months, for a specified amount of money. If her guardian agrees to the terms then they are married and the marriage is annulled when the time has elapsed.?

I joined naseeb about two years back. But when I signed in after a year, trip on naseeb has not started well. Since I am here each day encountering new experience--encouraging and disappinting. Now here the people (sorry to say and with due respect) are to me and my friends bunches of morons too available here. All because of some decent men still worth visited site. Now people are here, eager to peep through other lives??.. Nothing else I want to say because editing (censor) policy also counts. But the issue which compelled me apart infinite other was that one out of the filthy minded people on this site, from New Jersey, happened to be Shia (though me too Shia, that's why writing), busy in making mind of Sunni girls for Mutta-----that in Shia is Mutta has been practiced not a nikah. Hmm if such kind of question or proposal he made to Shia girl then he definitely deserve harsh treatment means will get better treatment because woman is not a commodity or a toy. He is simply targeting Sunni girls, and even he proposed one of my innocent friend. I wish I could here mention his ID but bound to do so (but available on request if I think circumstances are valid to expose). He is still harassing my friend though she in clear words expressed that let her alone. He always start to say brainless about her and rude when she blocked him on messneger he started to sent rude/filthy text message on her phone. He is so bad. He scolded her by saying she has no guidance from Allah and not a good muslim and person. (He needs to be fixed folks! what do you think). She told him that he is so superior than me so he should leave heralone. He is not Allah that to judge her. Who does he think he is? (I have never heard anyone like him in my life). She requested not to communicate with anymore and he didnt respect her wishes and insisted on being friend and then he went on to bother her by sending text message on my phone! (That is so wrong!)

?There is no way one can clean the minds of perverts who harass women, and most definitely no way they can control their sexual urges. No offence, but men are, were and always will be perverted jerks?, (Maha Khan).

Once were the golden times when men always lowered their gaze and never dared to look a woman in the eye, but now it is so different. To some extent we women are responsible for fuelling their courage because if a man walks with his eyes cast low, a woman begins to feel there is something wrong with her, (how poor creature you woman, be strong what?s wrong with you).

Why don't we raise a question on their behavior towards us on many occasions? The double standards are unbecoming of a society. Is this how those men would treat their sisters? Here I have a question to all those guys that if they are compelling girls for Mutta are they ready to give there daughters and sisters too in Mutta. I am sure they will nod negatively. And if really interested in marriage then why temporary marriage (to me is fraudulent marriage) called ?Mutta? why not nikah?
I simply don?t want to go in detail just want to highlight on the nature of ?Mutta? to make people (especially girls) aware, and me doing so being Shia. Because if we women are aware then no body dare to exploit us and if want to nip this problem (exploitation/sex-victim) in the bud. I must say ?This is the worst form of sexual exploitation." Before I head toward the details I would like to request whenever you have any problem or issue try to discuss matter with your family, trustworthy friends or people in your circle having enough knowledge, as my friend did who explored the topic with me and sort out the details and legal status of the issue.
Lapse of 1400 years after Islam legitimized free sex with a slave woman had rendered the whole thing so unreal that it was unbelievable. I hadn?t heard of Mutah (temporary marriage) in Islam yet. That shocker would come later.

From the study of Hadith it would seem that was form of legalized prostitution tolerated by the Prophet in earlier days of Islam, but later on HE (s.a.w) prohibited it. It is to be noted that only one school of Mohammedan law?the Ithna Ashari allows such marriage. Not only Sunni schools but all the other Shiites ?like Zaidi and Fatimid consider such marriage illicit.
"The system started centuries ago when soldiers would stay away from home for long periods. Since they did not want to stay with a woman without giving her the status of a wife, they would marry and, later, divorce them legally. This gave the woman a sense of security as she was entitled to alimony after the soldier left and was free to remarry. Those conditions are no longer relevant today?.
The word Mutta literally means ?enjoyment, use? and in its legal context it may be rendered, according to Heffening a ?marriage for pleasure?. It is a marriage fro fixed period for a certain reward paid to the woman. The institution of Mutta was fairly common in Arabia both before and at the time of the Prophet (PBUH).it seems fairly certain that it was tolerated by the Prophet (saw) for some time, but all schools of law, except one Ithna Ashari Shitte, are agreed that finally declare such union as unlawful.

Shias claim Mutta to be legal and according to Islam. Is this claim correct? What does the Quran say? What does history say?
Fixed-Term/Temporary/Pleasure Marriage are different names for the Arabic word of "Mut'a" which is a contract between a man and woman, much in the same way the Long-Term/Permanent/Conventional Marriage is. The main difference is that the temporary marriage longs only for a specified period of time, and man and woman will become stranger to each other after the expiration date without divorce. One misconception regarding temporary marriage is that some people think that the woman engaged in temporary marriage can have contract every other hour. This is completely misrepresentation of temporary marriage. After such contract has been expired, the woman has to wait for two months (Iddah) before which she can not marry any one else.

?It is lawful among Shias?, says Wilson, ?to enter into a contract of (so called) marriage for a limited period, which may be a term of year, a month a day or even part of a day.?

The marriage dissolves of itself, on the expiration of the term of marriage. If no time-limit is expressed, the marriage is presumed to be permanent and thus it will not be Mutta marriage.

The number of wives that can be taken into Mutta Marriage is unlimited. The ceiling of four wives does not apply here. A Shia male may contract Mutta with a Muslim. , Christian, Jewish or Parsi (fire-worshipper) woman, but not with a woman following any other religion. A woman may not contract Mutta with non-Muslim.

The amount of dower must be specified in the contract of Mutta otherwise the agreement is void.

The child born of a Mutta Marriage is legitimate and capable of inheriting from the father. But, in the absence of an express agreement, neither party to a Mutta is entitled to inherit from the other. Maintenance is not due to the Mutta wife unless it has been expressly been agreed upon.

Fyzee says that the old Arabian custom of Mutta was justified as being useful in times of war and on travels; but even after the prohibition by Prophet(saw) it persisted an was really suppressed and ruthlessly condemned by Caliph Omar (RA).

It is extremely important for you to now know the incidents concerning Mutah.

Incidents of marriages in the Mutta:

The incidents marriage in the Mutta form is as under:

1) There are no mutual rights of inheritance between husband and wife, except by a special agreement.
2) If the marriage has been consummated then only wife is entitle to full specified dower, otherwise to half the dower only.
3) The wife is not entitle to maintenance under the Shia Law.
4) The children born out of marriage in the Mutta form are legitimate.
5) These children have rights of inheritance from either party, i.e. their father and mother.
6) where cohabitation between man and woman commences in the marriage in the Mutta form, and there is no evidence as to the period for which such marriage was contracted, and the cohabitation continues, the inference would be unless contrary is proved that Mutta form of marriage continue during whole period of cohabitation and the children during this period would be legitimate and capable of inheriting from their parents.
7) If party continues to live as husband and wife after the expiry of specified period, the inference would be that the term was extended during the whole period of cohabitation and the children conceived during this period are legitimate.
8) On the expiry of the term, a marriage in the Mutta form is deemed to be dissolved ipso facto; such a marriage is also dissolved by death.
9) No right of divorce is recognized in Mutta Marriage, but the husband may make a gif of the unexpired period (hiba-i-muddat) or the parties may separate by mutual consent.
Here I am going to give reference of the case which came to notice during July 2003, in India.
Married off to a 47-year-old Yemeni national for just Rs 10,000, the world of young Saira, who is not yet out of her teens, lies shattered. Saira is very innocent and was cheated by a trusted aunt Nasreen and her companion Karim who sold her to the old Yemeni national who, is already married and has eight children in Yemen. Saira was fraudulently married off at a lodge in Dombivali." Dombivali is a town in Thane district adjoining Mumbai. The victim?s father is a beggar who has four more daughters. "We have no financial support as we survive on the alms that the father gets daily from nearby streets. The case was exposed by a newspaper and the NCW quickly sprung into action. The accused are in Kalyan jail at present while the "Maulavi" and manager of the Dombivali lodge are untraceable.
This is not an isolated case. Many cases of fraudulent marriages go unnoticed by the Indian Government, NGOs, police and even the media. However, CBI enquiry into these cases could curb the menace to a certain extent. The case of 16-year-old Saira (name changed), who was sold and fraudulently married to one 47-year-old Yemeni national Abdul Karim in May this year in the metropolis, is just a tip of the iceberg, according to the National Commission for Women (NCW). Even the State Commission for Women president Nirmala Sawant-Prabhavalkar agrees with the view, complaining that thousands of cases of child trafficking do take place in the metropolis." due to the lack of proper machinery, we sometimes fail even to take cognizance of them and police fall short of breaking the nexus, she said and expressed ignorance about Saira case.
Due to efforts, an order was issued last year by the Indian External Affairs Ministry to all the foreign embassies to ensure the tourists from other countries, especially Gulf countries do not convert tourism tour into sex tourism.
In India,Mohammed Ali road, Nagpada, Mahim and some other areas in the city have many guest houses which encourage this illegal activity. Such alliances are backed by a small group of unscrupulous "Kazis" and agents, the sources said.
In a particular place in Nagpada, a "Kazi" receives groups of people, mostly Arabs and Algerians who are very old. He prepares a "Nikahnama" and "Talaqnama" simultaneously and then performs the marriage of the old clients with victims who are mostly minors. The fee ranges from Rs 10,000 to Rs one lakh and even more, depending on the girl?s beauty. The client then spends one or two nights with the girl and then goes away. The girl?s parents are paid half the amount and the balance is pocketed by the agents, the sources alleged.
According a leading Muslim social activist in Mumbai who works for the welfare of such sex victims, the police can easily keep track on the movements of the visiting foreigners, but they are not doing enough. The involvement of mafia gangs in this racket cannot be ruled out. Dowry is prevalent in Marathwada while in Mumbai, it is prevalent among up Muslims, she says adding that the girl (Saira) is the victim of the "Mutta" marriage system.
"Mutta" marriage is a temporary contract of matrimony. Nubile girls, some barely entering their teens, are wedded off to moneyed men on the assurance that after a fixed period, they would return to their homes with a handsome alimony.
Clearly, economic considerations determine these contractual arrangements. The practice is generally confined to impoverished Muslim families and can be witnessed in places as varied as Hyderabad, Raipur, Satara and Chatturbhuj.
The cases are not only in India but also in Pakistan, Damam, Iran and list goes on and on. Only awareness could keep women in safe zone. We are not belongs to centuries-old tradition of women who had been snatching personal freedom from the jaws of oppressive custom. It is not a call to arms, but a deliberate disregard of gender roles, a refusal to follow social norms, an individual rebellion to such norms and acts by males could make us feel we ?woman/girl? are also a being. Muslim women are now better off. As Maha Khan narrated in her one write up/naseeb vibe ?Men are Jerks? that: ?Women?s rights are emphasized, not only in Islam, but as a general principle of life. Women have the right to stand up for themselves, and say what they believe. They have the freedom of speech, yet only one in every fifteen women being abused will speak up. Why do we live such a suppressed life??
So stop saying me ?Like a puppet on a string, I played as you made me, I lived as you made me. Be a woman---you are a mother and sister and a wife so try to recognize your rights and don?t let allow other to exploit you.

Not much has changed since the time of the prophet (saw) in terms of man's nature. There are still few men in comparison to women due to war and now homosexuality. Also, in the states, there are many men studying or working hard to support their families overseas and most of them if not all take wives while they are in the states and later divorce them when they either return to their respective countries or their first wives join them. Muta?? Maybe not by definition but the concept is still there and obviously the need for it. Now, I think it is unethical and immoral for people to go into marriage with the intent to divorce after certain needs have been fulfilled. That is not what marriage is all about.

The problem is now so many young muslims are not educated in the religion. There is something to be said about a person who knows the religion and what is required from him/her and the one who doesn't. What's even more distressing, the bulk of the problem later falls on uneducated (deen wise), unsuspecting, and usually very decent women (muslim and non-muslim). The only way to counter such behavior and thinking is with awareness and understanding of islamic legal rulings.

Honestly, I think this article is interesting...However, I am sure that this temp. marriage was not intended for neither modern times or to earn money. At the time of the prophet (s.) There was less men and more women due to battles, traveling, death etc. Hence this arrangment took place, so that when men were gone for years at a time in a battle they could be only with one women during that time, and can go back after that to their wifes etc... I am not an expert but I do know this much.

Thank you for posting this cry of your heart denouncing such terrible practices that you call by their right name: women sexual exploitation and a poorly disguised form of prostitution, making women's family that force them into it at not less than pimps.

Thank you for your courage. One can feel the hurt and the rage in your tone. Even that if every human being could respect each other through their journey in life, see the divinity in each other, that would make a better world. It is not the case, but it is also not prudent to generalize. They are many good men and they are good women who live by their ideal, who follow the way of peace, of Islam and who show respect to everyone as being in the presence of Allah. Unfortunatly they are many who choose to manifest not their divinity but the lowest animal form in their consciousness.

It is important that people such as yourself speak loudly about injustice and give a voice to those who cannot utter a whisper of rebellion against such oppressive practices.
